According to the Chicago Tribune, a couple that was injured by a water tower that fell off a Lincoln Park building filed a lawsuit against the Brewster building’s condominium association for negligence.
One of the parties in the suit, Jack Baginski, was assisting his girlfriend and other party to the lawsuit, Lauren Hussar, in moving out of the building next to the Brewster building one morning. At that time, the wooden water tower, which was full of water, gave way and fell into the alley. Hussar sustained injuries and she remains to be hospitalized, although her injuries were not specified in this report. Baginski was injured by the flying debris and water that washed him away from the scene of the accident. There was another woman that was injured in the accident but is not a party in the lawsuit at this time.
Legal representatives for the couple state that they are seeking the full maintenance and all of the inspection records for both the building and the water tank above it. Previous reports state that the building was cited in 2010 for several code violations including the misplacement of the steel bands that are around the tank of water. There were several repairs made and the building passed inspection after those repairs were made.
Neither the plaintiffs nor the defendants were willing to give a comment on the lawsuit. The lawsuit does not specify the amount of damages that they couple are seeking.
