Pre-Divorce Checklist

Posted on August 09, 2018 in Family Law

IL divorce lawyerAt one point in your life, you may come to the conclusion that a divorce is right for you and your family. To ensure you are well prepared and allow the process of ending your marriage to go as smoothly as possible, be sure to keep this pre-divorce checklist in mind.

1. Reach Out to a Divorce Lawyer

It is smart to speak to a divorce lawyer once you have come to the final decision that you are getting divorced. They can provide you with information on what to do and what to avoid before you start filing paperwork.

2. Gather Financial Documents

Although gathering financial documents may be time-consuming, this to-do item is essential if you would like to protect yourself financially. Go through your house and search for documents such as bank statements, tax returns, investment statements, retirement account statements, life insurance policies, mortgage documents, Social Security documents, credit card statements, and wills.

3. Conduct a Home Inventory

Since property division will be a part of your divorce case, it is wise to conduct an inventory of all of the major items in your home. Write down all of the furniture, appliances, expensive jewelry, and artwork you own. Be sure to include any valuable items that are stored out of your home as well.

4. List Your Budget

Understanding your household budget is essential. Take the time to write down your expenses on a weekly, monthly, and yearly basis. This information can help a judge determine spousal support and child support.

5. Determine How Much Your Spouse Earns

You should find out exactly how much money your spouse earns. Take a look at their pay stub if they work for an employer. In the event they are self-employed, a business owner, or get paid in cash, make an effort to keep track of their income for a few months.

6. Find Out Your Credit History

Knowing your credit history is important in a divorce, especially if you are planning on moving out of your family home. It can be difficult to find a new place to live or buy a new car if you do not have a good credit score. If you have poor credit, take steps to improve it as soon as possible.
